{"id":2836,"date":"2023-07-17T21:51:48","date_gmt":"2023-07-17T20:51:48","guid":{"rendered":"https:\/\/wpcgh1a0h5.s5gec13u.uber.space\/?p=2836"},"modified":"2026-05-10T14:09:07","modified_gmt":"2026-05-10T13:09:07","slug":"gia-latest-draconian-law-proposal-from-the-eu-about-5g","status":"publish","type":"post","link":"https:\/\/esc-info.eu\/es\/gia-latest-draconian-law-proposal-from-the-eu-about-5g\/","title":{"rendered":"GIA \u2013 Latest Draconian Law Proposal from the EU about 5G"},"content":{"rendered":"\n<p>Updated in November 2025: <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/sk\/mex_25_2668\" target=\"_blank\" rel=\"noreferrer noopener\">European Commission Daily News 12 \/ 11 \/ 2025<\/a> (4th subtitle)<br><strong>Rules to ease the rollout of better connectivity networks enter into effect<\/strong><br>The\u00a0<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/gigabit-infrastructure-act\">Gigabit Infrastructure Act (GIA)<\/a>\u00a0enters into effect today, aiming to make fast and advanced connectivity widely available across the EU by tackling persisting challenges that operators encounter when setting up infrastructure. The act further aims to reduce costs and complexities in the deployment of fibre and 5G networks in the EU. \u00a0<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Its full name is the Gigabit Infrastructure Act. <\/strong>The EU strategy is now to harmonize and make connectivity easy and smooth. All should be able to enjoy their \u00abdigital rights\u00bb meaning the \u00abright\u00bb to be online 24\/7.<\/p>\n\n\n\n<p>The law proposal aims to take responsibilities away from local authorities so they don&#8217;t need to worry about whether this is good or bad, legal or illegal, healthy or unhealthy.<\/p>\n\n\n\n<p>It consists of 15 articles, and 2-3 are of special concern. Article 1 and 2 defines the key words that are used throughout the text. Understand those and you will understand what the EU Commission has in mind.<\/p>\n\n\n\n<p>The key point for them is to facilitate connection to get everything installed, cells, cables, routers etc., and the goal is that we all get cheaper and faster access to it all. Article 8 says that any new building has to be fibre ready according to national standards.<\/p>\n\n\n\n<p>They do away with Impact Assessments because it takes too much time and will stop the implementation on all levels in the EU countries. There is discrepancy between local rules, and they want to overrule that, so decisions are taken at the top level of national governments, not at the local level. In Article 7 you will see that local authorities are restricted.<\/p>\n\n\n\n<p>Article 9 gives rights of users to refuse access to their buildings, so that is one good point in the text.<\/p>\n\n\n\n<p><em><strong>Actions are needed to alert&nbsp;<em>local authorities that they are about to lose their authority in relation to where masts and antennas can be placed in the municipalities <\/em>with this new legislation.<\/strong><\/em> They are still responsible for the health of their citizens and cannot avoid that even though the EU adopts this new law as a Regulation (immediately binding in all Member States.)<\/p>\n\n\n\n<p>We need to influence the process, but the time is limited since the EP (European Parliament) will discuss it, and ITRE (the responsible committee within the EP) will vote on 19 September 2023. Later on, the EP will vote in plenary. ESC&#8217;s Political Working group is working full speed to influence the different levels of competence in the EU.<\/p>\n\n\n\n<p><strong>What can <\/strong><strong>you do?<\/strong><\/p>\n\n\n\n<p><strong>Get yourself acquainted with the law.
